Will Joe Nacchio attend his appellate hearing next week?

It's not required.  But many think he won't be able to stay away, given the significance of the hearing and his propensity to be actively engaged in his defense.

"I sure would attend if it was my almost, maybe last shot at freedom," said Marcy Glenn, head of Holland & Hart's appellate practice group in Denver.

Maureen Mahoney, Nacchio's appellate attorney in Washington, D.C., declined to comment on whether Nacchio would attend.  "I am not going to be discussing the argument," she said by e-mail Monday.

Nacchio was active during his insider-trading trial last spring, often engaging in intense discussions with his defense team.  And who can forget his effort to address the court at the end of his sentencing?  His bid was rejected as too late, however. 

Glenn said her advice to clients is that it generally doesn't make any difference whether they attend appellate hearings or not.  But she stressed, she mostly represents large corporations.

"I sure would attend," she reiterated.
