Racketeering suit vs. Qwest won't be revived

WASHINGTON The U.S. Supreme Court refused to revive a multibillion-dollar racketeering suit filed against Qwest Communications by the trustees of a now-bankrupt joint venture the company formed in the Netherlands.  The justices let stand a lower court ruling that the KPNQwest NV trustees' claims should be adjudicated in the Netherlands rather than in New Jersey.

The trustees were seeking to take advantage of the triple-damages provision in a U.S. racketeering statute.

The failed company, a Hoofddorp-based joint venture of Qwest and Hague-based Royal KPN NV, was created in 1999 to construct a European fiber-optics telecommunications network.
