Family to drop suit against ranch over Qwest exec's death

DENVER—The family of a Qwest executive killed while turkey hunting in 2005 is dropping a lawsuit filed against the ranch that hired the suspect, according to a court document.  The family of Jeffrey Garrett of Aurora had filed a lawsuit that said Oscar Hoyos DeLaCruz was working on the Bear Wallow Ranch in Garfield County when he fired a .22-caliber rifle at what he thought was a turkey.

The shot struck Garrett, an assistant vice president for Denver-based Qwest Communications International Inc., who was hunting on federal land near the ranch.  DeLaCruz fled to Mexico.

A document filed Wednesday in U.S. District Court said the Garretts and the ranch agreed the complaint would be dismissed, with each side paying its own costs.  A reason was not listed.

The court still has to enter an order dismissing the suit.

A phone message left after business hours to the Garretts' attorneys was not immediately returned.
