The attached letter in
Adobe PDF file format was faxed last night to the SEC's
offices in Denver and Alexandria, VA. This is a request
under the Freedom of Information Act ("FOIA") for copies of
the transcripts of the SEC's interviews/depositions of about
80 persons concerning the SEC's 'investigation' into Qwest's
federal securities laws violations.
This is the beginning of
our second major effort to gather important information
utilizing the federal law FOIA. The first FOIA request we
made in March 2004 concerned the Department of Labor's
so-called 'investigation' into the Qwest Pension Plan. As
you know, we had to file a federal lawsuit when the
Department of Labor (DOL) tried to stonewall us. Then,
after the lawsuit was filed, the DOL had a change of
position and agreed to release to me the requested
information. But, I am still awaiting delivery of the two
full boxes of papers the DOL folks in Washington D.C. say
were shipped to me last Thursday. I will let you know what
is received and what we learn about the DOL's so-called
'investigation' of the Qwest Pension Plan.
In this latest
FOIA demand, the requesters are Nelson Phelps and Mimi
Hull, who are always looking out for the best interest of AUSWR
membership. The information obtained should be very
insightful to those persons who suffered economic
losses on investments in Qwest stock. Don't expect any
response from the SEC as we approach the holiday season. We
will keep you advised of developments after the beginning of
the year.
