This is the latest about the Colvin v. Qwest (Retiree
Telephone Concession case). . .
Yesterday, Qwest counsel and I submitted to Judge
Michael A. Schiferl a combined 128 pages of documents in
support of a final judgment which we will ask Judge Schiferl to
enter during the upcoming Fairness Hearing.
Attached hereto is a copy of the papers submitted to
Judge Schiferl. The file attachment is large - 128 pages or
about 1.5 MB. This includes the Joint
Motion, Plaintiff's memorandum brief, Affidavit by CLK in
support of an award of attorney's fees, Notice of the 21 persons
who opted not be included in the settlement,
Defendants' memorandum brief with Exhibits (Affidavits) 1-5, the
proposed final judgment order and the proposed claim form to
be mailed to class members within several weeks after the
Fairness Hearing.
Please note that a final "Fairness Hearing" will be
held at the Otero County District Court in La Junta,
Colorado on Wednesday, June 22, 2005, at 1:00 p.m.
