This is the latest about the Colvin v. Qwest (Retiree
Telephone Concession case). . .
Today, Qwest counsel and I submitted to Judge
Michael A. Schiferl a stipulation concerning information to
be included in the class notice to be mailed by Qwest. A copy of
the stipulation and proposed order for Judge Schiferl to sign are
attached hereto.
Please note that a final "Fairness Hearing" will be held
at the Otero County District Court in La Junta, Colorado on
Wednesday, June 22, 2005, at 1:00 p.m.
Also, we have an agreement that Qwest will establish and
maintain through the date of the June 22 Fairness Hearing a
Settlement Website containing printable copies of the following:
1) Amended Class Action Complaint, 2) Settlement Agreement, 3)
Stipulated Motion for Entry of Order Regarding Conditional
Settlement, Class Certification and Preliminary Settlement
Approval, 4) Parties Submittal of Affidavits in Support of
Motion Seeking Preliminary Approval of Proposed Settlement, 5)
Order Amending Preliminary Settlement Approval, and 6) Notice
of Proposed Settlement (so as to provide class members with
ready access to these materials).
The notice of the settlement will be mailed out by Qwest
to the 3-4,000 retirees by the end of next week. The notice
will explain the terms of the proposed settlement and give
retirees opportunity to submit a written objection or to ask to
be excluded.
