This is the latest about the Colvin v. Qwest (Retiree
Telephone Concession case). . .
Today, I received Judge
Michael A. Schiferl's April 7, 2005 orders and copies are
attached hereto. In his first order, Judge Schiferl makes
findings of fact and conclusions of law and rules Ms. Rathbun and
her Washington, D.C. attorneys should not intervene in the case. In
his second order, he grants preliminary approval of the proposed
class settlement agreement that we submitted back in late October
2004. We can now go forward with the process.
Soon, Qwest will prepare a notice of the proposed settlement
and mail it to the 3-4,000 retirees living within Independent
Telephone Company territory whose retiree telephone concession
benefit was ended in January 2004. The notice will explain
the terms of the proposed settlement and give retirees opportunity
to submit a written objection or to ask to be excluded.
